US Court Orders Release of Abrego Garcia from Immigration Custody
A federal judge has ordered the prompt release of Kilmar Abrego Garcia from immigration custody, finding his ongoing detainment lacks lawful basis.
"Since his release after wrongful imprisonment in El Salvador, he has been taken back into custody, again without lawful authority," Judge Paula Xinis wrote in her ruling.
The situation originates in a erroneous removal to El Salvador in March, which the government later acknowledged was an mistake. After his repatriation to the United States to face human smuggling charges, he was held in immigration custody.
In her decision, the court noted that the authorities lacks a valid deportation order, which prevents them from removing Mr. Abrego Garcia "at this juncture."
Context of the Legal Challenge
The legal proceedings involve disputed assertions. Whereas the Trump administration argues that Abrego Garcia is a member of the MS-13 criminal organization, he categorically disputes this claim.
He has also pleaded not guilty to the conspiracy counts, which are part of a separate criminal case in Tennessee.
Conditions of Release
The court, who was hearing his petition to deportation in a federal court, ruled that he must now adhere to the conditions of his bond from jail in Tennessee. This order shifts his supervision to the jurisdiction handling his criminal case.
This decision marks a significant development in a complex legal battle involving claims of wrongful detention and disputed gang affiliations.
